What is third party copyrighted material?

A "work", third party copyrighted material, means a production in which thoughts or sentiments are expressed in a creative way and which falls within the literary, scientific, artistic or musical domain (Copyright law of Japan, Article2(1)(i)). You may use third party copyrighted material (e.g. an image, picture, photo, illustration or movie) casually in your lecture. However, you need to make a reference to them in your slides when you use them in OCW.

Please see the below link for more information.

Copyright for E-learning

According to Article 35, you can use third party copyrighted material without permission for the educational purpose only. However, this exception provided by Article 35 does not apply to the case of OCW. You need to make a reference to third party copyrighted material, e.g. an image, picture, photo, illustration or movie, in your slides.

Inappropriate images etc.

Images etc. have no connection with the contents of lecture

You can not use images etc. with no connection to your lecture for the purpose of decorating your slides because this utilization dose not satisfy the condition of citation. However, the precise definition is difficult, therefore the center staff can advise you.

Images etc. cited from personal SNS site or of untrustworthy origins

Sometimes, personal SNS site uploads images etc. of unknown origins, therefore we recommend you to change them to alternative images from official sources.

Images etc. from stock photo sites without payment

You must pay for the images etc. sold by stock photo sites (e.g. Getty Images). You can not use their images etc. without payment. Please purchase them upon the confirmation of their licenses or change them to alternative images.

Make a reference to third party copyrighted material in your lecture slides

List of Materials of Unknown Origins

For the purpose of publishing OCW online, the center staff searches the origins of images you used in slides or prepares alternative images.

After submission of the List of Materials of Unknown Origins

Search for original sources of references by the center staff

The center staff searches for original sources of references, and adds the references to the slides after they found them.

Proposition of alternative images

If the center staff can not find the original sources, they propose alternative images.

Creation of substitute images

In case the center staff can not find an appropriate alternative image, they create a necessary substitute image. Please understand this can not be made in time if you request a publication of OCW within a short period.
